Agreement to Terms

By accessing or using MyChartsBook ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including free and paid subscribers.

Description of Service

MyChartsBook is a trading journal and pattern recognition platform that allows you to:

• Upload and organize chart screenshots into "Master Files"
• Log trades with entry/exit prices, P&L, and performance metrics
• Record strategy backtests with win rate and profit factor statistics
• Write trading journal entries
• Track performance through dashboards and analytics

Account Registration

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your password
• You must be at least 18 years old to use the Service
• One person may not maintain multiple free accounts
• You are responsible for all activity that occurs under your account

Subscription Plans and Payment

Free Plan

• Limited to 3 master files and 100 screenshots
• Access to trade log, weekly calendar, and trading journal
• Available indefinitely at no cost

Pro Plan ($19/month)

• Unlimited master files and screenshots
• Access to backtest log and advanced analytics
• CSV export functionality
• Priority support

Billing

• Pro subscriptions are billed monthly or yearly in advance
• All payments processed securely through Stripe
• Prices are in USD and exclude applicable taxes
• You can cancel anytime; access continues until the end of the billing period
• We offer a 14-day money-back guarantee for first-time Pro subscribers

Acceptable Use

You agree to use MyChartsBook only for lawful purposes. You may not:

• Upload illegal, harmful, or offensive content
• Upload malware, viruses, or malicious files disguised as screenshots
• Attempt to gain unauthorized access to other users' accounts or data
• Use automated scripts to scrape data or abuse the Service
• Resell, redistribute, or sublicense access to the Service
• Use the Service to violate any securities laws or regulations
• Misrepresent your identity or affiliation

Your Content and Data

Ownership

You retain full ownership of all content you upload to MyChartsBook, including chart screenshots, trade data, journal entries, and any other information you provide.

License to Us

By uploading content, you grant us a limited license to store, display, and process your content solely for the purpose of providing the Service to you. We will not use your trading data or screenshots for any other purpose, including marketing or analytics.

Data Portability

Pro users can export their trade log and backtest data to CSV format. You may request a copy of all your data or account deletion by contacting support.

Trading Disclaimer

Service Availability

• We strive to maintain 99% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We are not liable for losses caused by service outages or technical issues
• We reserve the right to modify, suspend, or discontinue features with reasonable notice

Termination

By You: You may cancel your subscription and delete your account at any time through your account settings or by contacting support.

By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service. We will provide notice and an opportunity to export your data when reasonably possible.

Limitation of Liability

To the maximum extent permitted by law, MyChartsBook and its operators shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Trading losses or investment decisions made using information from the Service
• Unauthorized access to your account due to password compromise

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless MyChartsBook, its operators, and affiliates from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Intellectual Property

The MyChartsBook name, logo, and all software, design, and content created by us are our intellectual property. You may not copy, modify, or distribute our platform or branding without written permission.

Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or a notice on the platform at least 30 days before taking effect. Continued use after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
